Your Legal Rights Before An Abortion
The decision to carry or to terminate a pregnancy is not an easy one. Complete and accurate information is needed to make this deeply personal decision one that you can live with. Contact us at 302-856-4344. Caring people are waiting to help you.
It is the law that no one can force another person to have an abortion. No one, not even your parents, not even your husband, can make you have an abortion. Only you can sign a consent form at an abortion clinic.
You have the right to insist that the abortion be performed by a licensed physician and that the physician be insured. This protects your interests in case of physical or mental injury or death due to the abortion.
Know who your doctor is! Write down his/her name and the name of the hospitals where the doctor has privileges. Also, ask if he/she has ever had a patient have complications while performing an abortion or other medical procedures. The likelihood of major complications is rare, but if something should happen you should be prepared.
You have the right to change your mind and keep your baby, even if you are on the table for the abortion. If you change your mind, you do have the right to ask for your money to be returned. The decision is yours, not the doctors or the nurse's.
Your Legal Rights After An Abortion
If you are physically and/or emotionally injured by an abortion you always have the constitutional right to seek financial compensation in a court of law, no matter what you signed prior to the abortion. Many people who are victims of malpractice during an abortion have successfully sued for damages and been awarded settlements.
